Purchase, use, or acceptance of Decathlon gift cards, both physical and electronic, constitutes your acceptance of these Gift Card Terms & Conditions (“Terms & Conditions”) below.

The Terms & Conditions expressly incorporate the Terms of Use, Privacy Policy, and other policies set forth on the Decathlon.com website. Decathlon USA LLC and/or Decathlon America LLC (“Decathlon”) and its successors, assigns, parents, subsidiaries, affiliates, and each of their respective officers, directors, members, employees and agents, are collectively referred to as “Decathlon”.

IMPORTANT: THESE TERMS AND CONDITIONS CONTAIN A MANDATORY ARBITRATION PROVISION REQUIRING THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES. AS SUCH, YOU AND DECATHLON EACH GIVE UP THE RIGHT TO SUE EACH OTHER IN COURT OR IN CLASS ACTIONS OF ANY KIND. PLEASE NOTE THAT THERE IS NO JUDGE OR JURY IN ARBITRATION, AND THERE IS LESS DISCOVERY AND APPELLATE REVIEW THAN IN COURT. PLEASE SEE BELOW FOR DETAILS, WHICH MAY SIGNIFICANTLY IMPACT YOUR LEGAL RIGHTS, INCLUDING THE RIGHT TO FILE A LAWSUIT IN COURT.

Purchase: Gift cards may be purchased at www.decathlon.com and in Decathlon stores nationwide. Gift cards are issued by Decathlon USA LLC and/or Decathlon America LLC.

Redemption: Gift cards can be redeemed for future purchases of merchandise or services (i.e., rentals, shop services) if applicable at decathlon.com and in Decathlon stores. Gift cards cannot be redeemed for purchases of used or refurbished products, or under “test and buy” or similar programs offered by Decathlon. Upon redeeming your gift card, if your purchase exceeds the amount of the gift card, you will need to pay the balance.

Consolidation Requests: Decathlon at its sole discretion may grant requests to consolidate gift cards on a case-by-case basis.

View Your Balance: To view your balance, please contact customer service (https://www.decathlon.com/pages/contact-us) or see a customer associate at any of our store locations.

Nonrefundable: Gift cards cannot be refunded or redeemed for cash or credit (except where required by law or as permitted under these Terms), and cannot be replaced or refunded if lost or stolen. When redeemed at Decathlon retail stores, gift cards containing an unused balance of less than $10 will be cashed out upon request (or as required by law). 

Not for Resale: Gift cards may not be resold. Gift cards purchased through any unauthorized resellers or other internet auction sites are not guaranteed by Decathlon.

Delivery: Digital gift cards (also known as e-gift cards) ordered through www.decathlon.com will be sent by email to the purchaser. 

Risk of Loss: You are responsible for safeguarding your gift card/gift card balance from unauthorized use. We are not responsible if any gift card is lost, stolen, or destroyed, or if your gift card is used without your permission. Decathlon is not responsible for, and assumes no liability for any fraud or other unlawful conduct by any third party associated with Decathlon gift cards.

Expiration: Decathlon gift cards never expire.

Enforceability: All provisions of these Terms & Conditions are enforced except where prohibited by law.

Representation and Indemnification: You certify and represent to Decathlon that your activities associated with a Decathlon gift card or decathlon.com account balance will comply with these Terms & Conditions and all applicable laws, rules, and regulations. You further certify and represent that you will not use Decathlon gift cards in a misleading, deceptive, unfair, or harmful manner against Decathlon or its consumers. You agree to indemnify, defend, and hold Decathlon harmless from and against any claims, expenses, or liabilities made against or incurred by any Decathlon entity in connection with your use of the Decathlon gift card or any violation of these Terms & Conditions.

Limited Liability: TO THE FULLEST EXTENT PERMISSIBLE BY LAW, DECATHLON MAKES NO EXPRESS OR IMPLIED WARRANTIES WITH RESPECT TO GIFT CARDS OR ACCOUNT BALANCES, INCLUDING WITHOUT LIMITATION, WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, YOUR SOLE REMEDY AND DECATHLON’S SOLE LIABILITY FOR A NON-FUNCTIONAL GIFT CARD WILL BE THE REPLACEMENT OF THAT GIFT CARD.

Disputes and Arbitration: ANY DISPUTE OR CLAIM RELATING TO GIFT CARDS OR YOUR ACCOUNT BALANCE WILL BE RESOLVED BY FINAL AND BINDING ARBITRATION BY A SINGLE ARBITRATOR INSTEAD OF A COURT BY A JUDGE OR JURY, EXCEPT THAT QUALIFYING CLAIMS MAY BE ASSERTED IN SMALL CLAIMS COURT. THE U.S. FEDERAL ARBITRATION ACT, AS WELL AS FEDERAL AND CALIFORNIA ARBITRATION LAW, APPLY TO THIS AGREEMENT. “DISPUTE” SHALL BE INTERPRETED AS BROADLY AS LEGALLY PERMITTED AND SHALL COVER ANY CLAIMS THAT AROSE BEFORE THESE OR ANY PRIOR TERMS AND CONDITIONS. YOU AGREE THAT ANY ARBITRATION WILL OCCUR ON AN INDIVIDUAL BASIS, AND THAT YOU AGREE TO GIVE UP THE RIGHT TO PARTICIPATE IN A CLASS ACTION OR CLASS ARBITRATION. THERE IS NO RIGHT FOR ANY DISPUTE TO BE ARBITRATED OR LITIGATED ON A CLASS ACTION, JOINT, OR CONSOLIDATED BASIS, INCLUDING IN A REPRESENTATIVE CAPACITY ON BEHALF OF THE GENERAL PUBLIC, OTHER CUSTOMERS, OR OTHER PERSONS (E.G., PRIVATE ATTORNEY GENERAL ACT CLAIMS). Arbitration will be administered by Judicial Arbitration Mediation Services, Inc. (“JAMS”) pursuant to the JAMS Streamlined Arbitration Rules & Procedures effective July 1, 2014 (https://www.jamsadr.com/rules-streamlined-arbitration/). The arbitrator may only award relief for or against the individual party seeking relief and only to the extent necessary to provide relief warranted by that party’s claim. The arbitrator may not grant relief to non-parties nor consolidate more than one person’s claims. You also agree that you or Decathlon may bring suit in court to enjoin the infringement or misuse of intellectual property rights. These Disputes and Arbitration provisions shall survive any termination of these Terms & Conditions. Any amendments to these arbitration provisions shall not affect any pending asserted claim or arbitration proceeding.

Governing Law: To the fullest extent permissible by law, these Terms & Conditions shall be governed and interpreted in accordance with the U.S. Federal Arbitration Act, applicable federal laws, and the laws of the State of California, without regard to principles of conflicts of law. Ordinary choice of law rules will apply in any adjudicating court proceeding if the dispute may not be arbitrated.

Updates: These Terms & Conditions were last updated on the date set forth above. Decathlon may change these Terms & Conditions at any time. Please check these Terms & Conditions periodically for changes. These Terms & Conditions shall apply against any contradictory or conflicting provisions in the Decathlon.com Terms of Use.
