Sea Otter Classic 2024 Instagram Giveaway Terms & Conditions (“Rules”)

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.  BY ENTERING AND/OR PARTICIPATING IN THIS INSTAGRAM GIVEAWAY AS DESCRIBED HEREUNDER, YOU AGREE TO THESE OFFICIAL RULES.

1. Eligibility: This Instagram giveaway is open only to those who attend the Sea Otter Classic 2024 Festival (“Festival”) and are 18 years and older as of the entry date. The Instagram giveaway is only open to legal residents of the continental United States and is void where prohibited by law. The Instagram giveaway is subject to all applicable federal, state, and local laws and regulations.
2. Agreement to Rules: By participating, the Participant (“You”) agrees to be fully unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of the Sponsor (as identified in these Rules) as final and binding as they relate to the content and operation of this Instagram giveaway.
3. Instagram giveaway Period: Entries will be accepted from 9:00AM (PST) on Thursday, April 18 to 11:59 PM (PST) on April 19, 2024.
4. How to Enter the Instagram Giveaway: You MUST complete the following steps to enter the giveaway:
1. Follow @DecathlonUSA on Instagram.
2. Like & comment on our first pinned post on our Instagram handle @DecathlonUSA from 9:00 AM (PST) Thursday, April 18th to Friday, April 19th, 11:59 PM (PST).
3. Two winners will be randomly selected at noon on Saturday, April 20th, using the tool iconosquare. 
4. The winner’s must be physically present at the booth #S500 at noon on Saturday, April 20th during the announcement to redeem the prizes. A new winner will be announced if the winner is not physically present. 
5. Winner #1 selects between a bikepacking kit: Saddle Harness - 8579468 ($99.99) & Saddle Bag Bikepacking 6-15L Bag - 8579464 ($39.99) or a mountain biking bag - 8300158 ($99.99), while Winner #2 gets the remaining prize. ​
5. Winner Selection and Notification: Participants can win only one (1) prize in exchange for completing the redemption form under the supervision of the Sponsor’s staff.
1. Odds: All Participants have an equal chance of winning, as only one entry per participant is permitted. The odds of winning depend on the total number of valid entries received.
2. The order of Winner #1 and Winner #2 will be determined by the Company. 
3. Winners must be physically present and follow us on Instagram @DecathlonUSA to claim their prize.
4. Prizes will be delivered to the Winner(s) immediately on-site. 
5. Prizes can't be exchanged for cash and/or another product. 
6. LIMITATION OF LIABILITY: BY ENTERING, YOU AGREE TO RELEASE AND HOLD HARMLESS DECATHLON AMERICA AND ITS SUBSIDIARIES, AFFILIATES, ADVERTISING AND PROMOTION AGENCIES, PARTNERS, REPRESENTATIVES, AGENTS, SUCCESSORS, ASSIGNS, EMPLOYEES, OFFICERS, AND DIRECTORS FROM ANY LIABILITY, ILLNESS, INJURY, DEATH, LOSS, LITIGATION, CLAIM, OR DAMAGE THAT MAY OCCUR, DIRECTLY OR INDIRECTLY, WHETHER CAUSED BY NEGLIGENCE OR NOT, FROM: (I) SUCH ENTRANT’S PARTICIPATION IN THE INSTAGRAM GIVEAWAY AND/OR HIS/HER ACCEPTANCE, POSSESSION, USE, OR MISUSE OF ANY PRIZE OR ANY PORTION THEREOF; (II) TECHNICAL FAILURES OF ANY KIND, INCLUDING BUT NOT LIMITED TO THE MALFUNCTION OF ANY COMPUTER, CABLE, NETWORK, HARDWARE, OR SOFTWARE, OR OTHER MECHANICAL EQUIPMENT; (III) THE UNAVAILABILITY OR INACCESSIBILITY OF ANY TRANSMISSIONS, TELEPHONE, OR INTERNET SERVICE; (IV) UNAUTHORIZED HUMAN INTERVENTION IN ANY PART OF THE ENTRY PROCESS OR THE INSTAGRAM GIVEAWAY; (V) ELECTRONIC OR HUMAN ERROR IN THE ADMINISTRATION OF THE INSTAGRAM GIVEAWAY OR THE PROCESSING OF ENTRIES.
7. Personal Data: You hereby authorize Decathlon America to collect, record, use, and reuse your Personal Data to send emails, solicit feedback from You, including through surveys, send marketing communications and promotional material, or provide information about promotions and products of Decathlon America. If you are a Winner of this Instagram giveaway, You further authorize Decathlon to publish or disclose your Personal Data as part of a winner’s list as permitted or required by applicable law.
8. Disputes: THIS INSTAGRAM GIVEAWAY IS GOVERNED BY THE LAWS OF THE UNITED STATES AND THE STATE OF CALIFORNIA WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES.
